1. About These Terms
These Terms and Conditions ("Terms") govern your use of Sunny, a pub and beer garden discovery service operated at sunnypubs.app ("Sunny", "we", "us", "our").
By accessing or using Sunny, you agree to be bound by these Terms. If you do not agree, please do not use the service.
These Terms are governed by the laws of New South Wales, Australia.
2. The Service
Sunny helps you discover pubs, bars, and beer gardens with outdoor seating. We provide:
- Venue discovery and search functionality
- Venue information sourced from Google Places and user contributions
- Pub crawl planning tools
- Related content and recommendations
What We Don't Guarantee
Venue information — including opening hours, outdoor seating availability, and other details — is sourced from third parties and user contributions. We do not verify this information and it may be inaccurate, incomplete, or out of date. Always check directly with a venue before visiting.
3. Eligibility
You must be of legal drinking age in your country or jurisdiction of residence to use Sunny. By using the service, you confirm that you meet this requirement. Sunny is a service designed to help adults find licensed venues and is not intended for use by minors.
4. Your Account
If you create an account with Sunny, you are responsible for:
- Keeping your login credentials secure and confidential
- All activity that occurs under your account
- Notifying us immediately if you suspect unauthorised access at sunny@sunnypubs.app
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Acceptable Use
You agree not to use Sunny to:
- Violate any applicable law or regulation
- Submit false, misleading, or defamatory venue information or reviews
- Scrape, copy, or systematically extract data from the service without our written permission
- Interfere with or disrupt the service or its infrastructure
- Attempt to gain unauthorised access to any part of the service
- Use the service for any commercial purpose without our prior written consent
- Impersonate any person or entity
We reserve the right to remove any content you submit and to suspend or terminate your access if we reasonably believe you have breached these Terms.
6. User-Submitted Content
Sunny may allow you to submit venue confirmations, ratings, or other contributions ("User Content"). By submitting User Content, you:
- Grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content within the service
- Confirm that you have the right to submit it and that it does not infringe any third-party rights
- Acknowledge that we may remove or moderate User Content at our discretion
You retain ownership of your User Content. We do not claim ownership over what you submit.
7. Intellectual Property
All content, design, code, and materials on Sunny — excluding User Content and third-party data — are owned by or licenced to us and are protected by copyright and other intellectual property laws.
You may not reproduce, distribute, or create derivative works from any part of Sunny without our express written permission.
The Sunny name, logo, and branding are our intellectual property. Nothing in these Terms grants you any right to use them.
8. Third-Party Services
Sunny relies on third-party services including Google Places, Google Maps, and others. Your use of these services through Sunny is also subject to their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service.
Links to external websites are provided for convenience only. We do not endorse and are not responsible for the content or practices of any linked site.
9. Disclaimer of Warranties
To the fullest extent permitted by law, Sunny is provided "as is" and "as available" without warranties of any kind, whether express or implied.
We do not warrant that:
- The service will be uninterrupted, error-free, or secure
- Venue information will be accurate, complete, or current
- The service will meet your particular requirements
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other non-excludable consumer guarantees.
10. Limitation of Liability
To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — Sunny, including but not limited to:
- Reliance on inaccurate venue information
- Loss of data
- Personal injury or property damage arising from visiting a venue found through Sunny
Where liability cannot be excluded under Australian Consumer Law or any other applicable legislation, our liability is limited to the maximum extent permitted by that legislation.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Sunny and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the service
- Your violation of these Terms
- Any User Content you submit
- Your violation of any third-party rights
12. Australian Consumer Law
Our service comes with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to a remedy. For other failures, you are entitled to have the failure remedied in a reasonable time. If this is not done, you are entitled to a refund for any payment made and, if the failure causes other loss, to compensation for that loss.
13. GDPR — Additional Terms for European Users
If you are located in the European Economic Area or United Kingdom, the following additional terms apply:
- You have the data rights described in our Privacy Policy
- Where we rely on your consent to process personal data, you may withdraw that consent at any time without affecting the lawfulness of prior processing
- We will not use your data for automated decision-making that has a significant legal or similarly significant effect on you without appropriate safeguards
14. CCPA — Additional Terms for California Users
If you are a California resident, your privacy rights are described in our Privacy Policy. We do not sell personal information as defined under the California Consumer Privacy Act. You will not be discriminated against for exercising your rights under the CCPA.
15. Changes to the Service
We may modify, suspend, or discontinue any part of Sunny at any time without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.
16. Changes to These Terms
We may update these Terms from time to time. We will indicate the date of the most recent update at the top of this page. Continued use of Sunny after changes are posted constitutes your acceptance of the revised Terms. If a change is material, we will take reasonable steps to notify you.
17. Termination
We may terminate or suspend your access to Sunny at any time, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination — including intellectual property, disclaimers, limitations of liability, and indemnification — will do so.
You may stop using Sunny at any time. If you have an account, you may request deletion by contacting us at sunny@sunnypubs.app.
18. Dispute Resolution
We encourage you to contact us first if you have a concern — most issues can be resolved quickly and informally.
If a dispute cannot be resolved informally, it will be subject to the courts of New South Wales, Australia, and you agree to submit to the non-exclusive jurisdiction of those courts.
For European users, nothing in this clause limits your right to bring proceedings before the courts of your country of residence or to seek relief from your local consumer protection authority.
19. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining Terms will continue in full force and effect.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sunny regarding your use of the service and supersede any prior agreements.
